Policies
New clients of BCI are required to pay for their services in advance.
Scheduling:
Please contact us via our contact form, by phone (443) 968-5610, or send us an email no less than 24 hours before your preferred shoot time. Most homes can be shot in 1 hour although some shoots may take longer.
Late Fees:
An invoice for services will be sent electronically to your email after your photo shoot is completed. Payment is due upon receipt. A $45 late fee per invoice will be assessed for every 30 days from the date of service for all unpaid invoices.
Cancellation, No Show and Inclement Weather:
- Appointments cancelled/rescheduled with 1 hour or less before the confirmed start time are subject to a $100 cancellation fee.
- Appointments cancelled/rescheduled with less than 4 hours, but greater than 1 hour before the confirmed start time are subject to a $55 cancellation fee
- Weekend/Holiday shoots are subject to a $100 cancellation/rescheduling fee with less than 4 hours notice
Arrival Time:
We will notify any client of a late arrival. We make every effort to always be on time. We know your time is valuable but we cannot control the traffic, weather, or other factors that may cause a delay.
The Shoot:
It is the agent and homeowners job to make sure the property is ready to be photographed before the photographer gets to the property. Agents and homeowners are expected to have the property cleaned and staged prior to the photo shoot. If the property is not ready to be photographed you should make every effort to reschedule 24 hours prior to the shoot.
Pets:
Please make sure pets are contained during the shoot. Pets are never included in photos and need to be out of the way during the shoot.
Photo delivery:
A 24 hour turn-around on listing photography from the time the photographer leaves the property. If you have not received your photos within 24 hours please call the office.
Travel Fees:
There may be a travel fee for photo shoots outside of our service area.
Retakes and Rainy Day Policy:
Any requested retakes of scenes that is not due to the fault of Bayshore Creative Images shall incur an additional fee.
3D Matterport Scans:
We will only be able to host scans for 6 months,
let us know before 6 months if the property is still active
after that a fee will be required for hosting.
Photo Rights and Usage:
Under our terms, the photos can be used only for the sale of the property. Because neither the current homeowner (the seller) nor the buyer will be signing a release agreement, neither the real estate agent nor I have the right to use or sell the photos for any purpose outside of the realm of real estate. As the photographer, I retain all ownership of the photos, and the right to use the photos for self -promotion as a photographer. Please see our complete copyright notice.
Can I give another Realtor/Person permission to use the photos BCIshot for me?
No, the photos are owned by Bayshore Creative Images. You do not have permission to distribute them to others for use. If another Realtor, or person would like to use the photos for any reason whatsoever, they must contact Bayshore Creative Images directly.
Notice of Copyright:
It is ILLEGAL to copy or reproduce the photographs, videos, website content, etc. issued under this agreement without the Photographer’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties. This agreement incorporates the entire understanding of the parties and is governed by the laws of the State of Maryland and or Florida. Any modification of this agreement must be in writing and signed by both parties.
All photos produced for the Client may be used by the current listing agent for all marketing associated with the current sale of the property in accordance with local MLS rules. Please note that the Photographer will copyright the photos and license granted only to the Seller or agent or licensee and NOT to any third party. If any photographs are posted on the local MLS, real estate website, the person/persons hiring BCI shall be solely responsible for their content, and shall hold BCI harmless for any possible claims, damages, or lawsuits arising from use of any such photos that may contain alterations done for cosmetic appearance improvement. BCI will NOT alter photographs to misrepresent the property.
Any authorized usage of the photos outside of the selling the home by anyone, including but not limited to realtors, architects, builders, stagers, designers, landscapers, sellers or buyers is prohibited unless approved in writing by the Photographer. Violation of this provision constitutes a violation of U.S. federal copyright laws and may subject the offending party/parties to legal action.
Licensing Rights and Photo Usage:
All images produced for an agent or broker may be used by that agent for any and all marketing materials and campaigns associated with the property and for the agent’s self-promotion. The photos may also be used by the agent’s parent company for the sole purpose of marketing the specific property photographed. Please note however, that all the images are owned and copyrighted by the photographer, and licensed granted only to the agent and the agent’s parent company and not to any third parties. You may not transfer or sell any of the images. Any usage of the images by a third party, including but not limited to architects, builders, stagers, designers, sellers, or buyers, is strictly prohibited unless approved and licensed in writing by the photographer.
